1. Eligibility
Open to legal residents of the 50 U.S. states and D.C., who are 18 or older. Void where prohibited. Employees of Austin Marathon, Revive Plunge, and their immediate families are not eligible.
2. Giveaway Period
Begins October 18, 2024, and ends at 11:59 PM CST on November 26, 2024.
3. Winner Selection
One (1) winner will be randomly selected on November 27, 2024. The winner will be notified via the email provided and must respond within 48 hours to claim the prize. If the winner cannot be contacted, is ineligible, or fails to claim the prize within the 48-hour window, the prize may be forfeited, and an alternate winner selected.
4. Prize
One (1) winner will receive a Revive Inflatable Cold Plunge, valued at $3,999 USD. The prize is non-transferable, and no substitution will be made except at the Sponsor’s discretion. Sponsor reserves the right to substitute the prize with another of equal or greater value if the advertised prize is unavailable.
The prize will be shipped to the winner’s U.S. address at no cost. Sponsor is not responsible for any delays or issues with shipping beyond its control.
5. Privacy
By entering, you agree that your information (email and phone number) will be shared with both Austin Marathon and Revive Plunge for marketing purposes. Your information will not be shared with any other third parties. You may unsubscribe from communications at any time.
6. Release and Limitation of Liability
By participating, entrants agree to release and hold harmless Austin Marathon, Revive Plunge, and their affiliates from any claims, including but not limited to technical errors, lost or misdirected entries, or injury/damage from participation or use of the prize. In no event shall the Released Parties be liable for attorney’s fees, and entrants waive the right to claim punitive, consequential, or indirect damages.
7. General Conditions
Sponsor reserves the right to cancel, suspend, or modify the giveaway if it is compromised in any way, including fraud or technical issues. Sponsor may disqualify any individual who tampers with the entry process or violates these terms.
8. Taxes
All federal, state, and local taxes on the prize are the sole responsibility of the winner.
9. Disputes
Entrants agree that any disputes related to the giveaway will be resolved individually in Texas courts and governed by Texas law. Class actions are not permitted.
